1. Definitions
In these Terms and Conditions, the following terms have the following meanings:
- Platform: AgentConsole HQ, including all software, features, tools, and services accessible through our website and Dashboard.
- Agent(s): The artificial intelligence agents available through the Platform, including all pre-built and custom agents created or deployed by Creative Sauce.
- Dashboard: The web-based control panel and interface through which Subscribers access, configure, and operate Agents.
- Subscriber: Any individual or entity that has created an account and is using the Platform under these Terms and Conditions.
- Lifetime Subscriber: A Subscriber who has purchased a lifetime licence to access the Platform and all current and future Agents.
- Monthly Subscriber: A Subscriber who is on a monthly recurring subscription plan.
- Service: All services, features, functionality, and support provided by Creative Sauce through the Platform.
2. Licence and Access
Creative Sauce grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Agents through the Dashboard for your personal or business use, subject to your compliance with these Terms and Conditions.
This licence expressly prohibits the following:
- Downloading, copying, or reproducing any Agent or its code or components
- Reverse-engineering, decompiling, or attempting to derive the source code or algorithms of any Agent
- Extracting or scraping Agent functionality or outputs for use outside the Platform
- Sharing your account access credentials with other individuals or entities
- Sublicensing, reselling, renting, or transferring your licence to third parties
- Attempting to circumvent access controls, usage limits, or subscription restrictions
Your access to the Platform is strictly personal and tied to your individual account. You may not use another person's account or allow others to use your account. Creative Sauce retains all intellectual property rights, ownership, and title to all Agents, including their code, algorithms, models, and configurations.
3. Subscription Plans
Creative Sauce offers the following subscription options:
- Cost: £8.99 per month
- Includes: Access to all available Agents with a monthly limit of 5,000 tasks
- Billing: Automatically charged monthly on the same date each month
- Cancellation: May be cancelled at any time with immediate effect at the end of the current billing period
- No long-term commitment required
- Cost: £299 one-time payment
- Includes: Unlimited access to all current Agents and all future Agents released by Creative Sauce during your lifetime, subject to fair use policy
- Billing: Single upfront payment, no recurring charges
- Cancellation: Non-refundable after the 14-day cooling-off period (see Section 8 for details)
- Lifetime access: Your access persists for as long as you maintain an active account
4. Dashboard Dependency and Service Availability
Critical Terms: Exclusive Cloud-Based Operation
All Agents operate exclusively through Creative Sauce's cloud infrastructure and can only be accessed via the Dashboard. This is a fundamental characteristic of the Service.
Agent functionality is entirely dependent on your active subscription and continuous access to the Dashboard. There is no offline, downloadable, self-hosted, or standalone version of any Agent.
To use the Agents, you must maintain an active subscription and have an active, authenticated connection to the Dashboard.
If your subscription expires, is cancelled, or is terminated for any reason:
- (a) Dashboard Access Revoked: Your access to the Dashboard will be immediately revoked and you will no longer be able to log in or access any Agents.
- (b) All Agents Suspended: All Agents associated with your account will be immediately suspended and will not perform any tasks or functions.
- (c) No Data Retention Beyond 30 Days: All of your outputs, configurations, customisations, and account data will be retained for 30 days after subscription termination, after which they will be permanently deleted.
- (d) No Replication or Circumvention: You may not attempt to replicate, reconstruct, or reverse-engineer any Agent functionality outside of the Dashboard or after your subscription ends.
There is no mechanism to export Agents, download functionality, or access Agent services through any means other than the Dashboard. You acknowledge and accept this as a condition of using the Service.
5. Acceptable Use Policy
You agree to use the Platform and Agents only for lawful and legitimate purposes. You specifically agree not to:
- Use the Platform for any illegal activity or to violate any applicable laws, regulations, or third-party rights
- Attempt to circumvent access controls, usage limits, subscription restrictions, or security measures
- Scrape, extract, harvest, or bulk-download Agent functionality, outputs, or data
- Reverse-engineer, decompile, disassemble, or attempt to derive the underlying code or algorithms of any Agent
- Share your account credentials or allow unauthorised access to your account
- Develop, sell, or distribute competing products or services based on Agents or their functionality
- Abuse the Platform's resources, including but not limited to attempting denial-of-service attacks or resource exhaustion
- Use the Platform to generate, distribute, or promote harmful, defamatory, obscene, or malicious content
- Engage in any fraudulent or deceptive activity
Creative Sauce reserves the right to suspend or terminate your access immediately if you breach this Acceptable Use Policy.
6. Intellectual Property Rights
All Agents, including their code, algorithms, artificial intelligence models, configurations, designs, and underlying technology, are the exclusive property of Creative Sauce Ltd. You retain no ownership or intellectual property rights to any Agent regardless of how long you use it or how extensively you customise it.
Your Content: You retain ownership of any original content you create and upload to the Platform, such as prompts, brand settings, configurations, and custom instructions. However, you grant Creative Sauce a licence to use, store, and process this content to deliver the Service.
Custom Agents (Agent Builder): Agents created by Subscribers using the Agent Builder tool remain the property of Creative Sauce Ltd. While you own the configuration inputs you provide (instructions, brand settings, data source selections, and scheduling preferences), the resulting Agent -- including its execution logic, integration with the Platform's infrastructure, and any learned behaviours -- is and remains the intellectual property of Creative Sauce. Custom Agents are hosted exclusively on the Platform, cannot be exported, downloaded, or transferred, and are subject to the same Dashboard Dependency provisions set out in Section 4. If your subscription ends, all custom Agents are suspended and their configurations are deleted after the 30-day retention period. Creative Sauce reserves the right to use anonymised patterns from custom Agent configurations to improve the Platform and develop new Agent templates for all users.
Anonymised Data: Creative Sauce may collect, analyse, and use anonymised and aggregated data from your use of the Platform to improve Agents, develop new features, and enhance the Service. This data cannot be used to identify you personally.
7. Data and Privacy
Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept our Privacy Policy.
Data Protection Compliance: Creative Sauce processes your personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and all applicable UK data protection laws.
- Encryption: All data is encrypted in transit using TLS/SSL and encrypted at rest on our servers
- Retention: Your data is retained only for as long as your subscription is active. After cancellation, your data is permanently deleted within 30 days
- Data Export: You may request an export of your personal data in a structured, machine-readable format at any time during your active subscription
- Your Rights: You have the right to access, correct, delete, and port your personal data in accordance with UK GDPR
8. Payment and Billing
Payment Processing: All payments are processed securely through Stripe. We do not store your full payment card details on our servers.
- You will be charged £8.99 on a monthly basis on the same day each month
- You may cancel your subscription at any time, effective at the end of your current billing period
- No refunds are provided for partial months or unused service time
- You will be charged £299 as a one-time payment
- This charge is non-refundable except within the 14-day cooling-off period (see Section 8.4)
- No further charges will be applied after the initial purchase
- If your payment fails, we will attempt to retry the charge up to 3 times over a period of 7 days
- If all retry attempts fail, your subscription will be suspended
- A suspended account may be reactivated by providing a valid payment method
For Monthly Subscriptions: You have 14 days from purchase to request a full refund with no questions asked.
For Lifetime Subscriptions: You have 14 days from purchase to request a full refund with no questions asked. After 14 days, the lifetime subscription is non-refundable under any circumstances.
9. Termination of Accounts
Termination by You: You may terminate your account and subscription at any time by logging into your Dashboard and selecting the cancellation option, or by contacting us at legal@creativesauce.io.
Termination by Creative Sauce: Creative Sauce may terminate or suspend your account immediately and without notice if:
- You breach any material term of these Terms and Conditions
- You violate our Acceptable Use Policy
- Payment cannot be collected from your account
- Your account is used for illegal or harmful purposes
- We believe your use poses a security threat or legal liability
Upon Termination: Regardless of who initiates termination:
- Your access to the Dashboard and all Agents will be immediately revoked
- All of your account data, outputs, and configurations will be retained for 30 days, then permanently deleted
- No refunds will be provided for unused service time, except as required by law during the cooling-off period
10. Limitation of Liability
As-Is Service: The Platform and Agents are provided on an "as-is" and "as-available" basis. Creative Sauce makes no warranties, express or implied, regarding the Platform, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Guarantees: We do not guarantee that the Platform will be error-free, uninterrupted, or that all defects will be corrected. We do not guarantee specific results or outcomes from using the Agents.
Liability Cap: To the maximum extent permitted by law, Creative Sauce's total liability to you for all claims arising from or related to these Terms and your use of the Platform shall not exceed the total fees you have paid to Creative Sauce in the 12 months preceding the claim. For Lifetime Subscribers, this cap is limited to the £299 lifetime fee.
Excluded Damages: In no event shall Creative Sauce be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, or business opportunity, even if advised of the possibility of such damages.
Uptime Target: Creative Sauce targets 99.5% uptime for the Platform. However, this is a target only and not a guarantee. We are not liable for unavailability due to scheduled maintenance, network issues, or circumstances beyond our reasonable control.
11. Changes to These Terms
Creative Sauce may modify these Terms and Conditions at any time. We will provide you with at least 30 days' written notice of any material changes via email to your registered email address.
Your continued use of the Platform after the notice period expires constitutes your acceptance of the modified Terms and Conditions. If you do not agree to the changes, you must cancel your subscription before the new terms take effect.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales, without regard to its conflicts of law principles. Any legal action or proceeding arising from or relating to these Terms shall be exclusively brought in the courts of England and Wales, and you hereby submit to the exclusive jurisdiction of those courts.
